On October 23, 2018, the Fourteenth Court of Appeals abated the appeal in the case of John Huynh v. David A. Fettner due to ongoing bankruptcy proceedings involving appellant’s brother, Phung Huynh, in the Southern District of Texas. The bankruptcy case, referenced under cause number 17-36801, was claimed to involve assets pertinent to this appeal. Recently, the court discovered through the PACER system that the bankruptcy case has been closed. The parties involved did not notify the court about the closure of the bankruptcy proceedings. The court has issued an order stating that unless a party files a motion showing good cause to retain the appeal within 20 days, the appeal will be reinstated and subsequently dismissed for want of prosecution. The decision was made by the panel consisting of Justices Jewell, Spain, and Wilson.
