The 11th Court of Appeals in Eastland, Texas, addressed the case involving the Ector County Alliance of Businesses against Greg Abbott, John W. Hellerstedt, and the State of Texas. The court reviewed the record and identified errors in the trial court's judgment. It partially granted the motion to dismiss filed by the defendants, vacating the trial court's order that had granted Hellerstedt's plea to the jurisdiction. Consequently, all claims by the Ector County Alliance of Businesses against Hellerstedt were dismissed for lack of jurisdiction. Additionally, the court vacated the trial court's orders concerning the Governor and the State, dismissing the Alliance’s second, third, fourth, and fifth causes of action against them for want of jurisdiction. However, the court upheld the trial court’s dismissal of the Alliance’s first cause of action against the Governor and the State. The costs of the appeal were charged to the Ector County Alliance of Businesses.
