The Alabama Supreme Court reversed the judgment in Simmons v. State, 179 So.3d 244 (Ala.Crim.App. 2014), which had previously overturned Charles Marques Simmons’s conviction due to a lack of jurisdiction by the Lowndes Circuit Court to hear his appeal from the Lowndes District Court. In light of the Supreme Court's decision in Ex parte Simmons, 179 So.3d 249 (Ala. 2014), the circuit court's judgment is now affirmed. Judges WINDOM, KELLUM, BURKE, and JOINER concur in this decision.
