City of Miami v. Diocese of Newton Melkite Church
Citations: 176 So. 3d 388; 2015 Fla. App. LEXIS 15559; 2015 WL 6161352Docket: No. 3D14-2504
Court: District Court of Appeal of Florida; October 21, 2015; Florida; State Appellate Court
The City of Miami petitions the Court for a second-tier writ of certiorari to overturn an appellate division decision that reversed the Miami City Commission's designation of St. Jude Melkite Catholic Church as a local historic site under section 23-4 of the City of Miami Code. After reviewing the record, including all submissions and oral arguments, the Court concludes that the appellate division provided procedural due process and applied the correct legal standards. The review process in second-tier certiorari is limited to these parameters. Consequently, the Court denies the City’s petition.
