The Court of Appeals for the Fifth District of Texas has granted a joint motion from the parties involved to vacate the trial court's judgment and dismiss the case with prejudice. The appellants, Jacqueline Shelby and Timothy Shelby, along with any other occupants of 6108 Lake Vista Drive in Dallas, Texas, have reached a settlement with the appellee, Wells Fargo Bank, N.A., resulting in the appeal being deemed moot since Wells Fargo no longer owns the disputed property. Consequently, the court vacated the trial court's April 4, 2019 judgment without addressing the case's merits and ordered the dismissal. The court also ordered that Wells Fargo recover its costs from the appellants, subject to any agreements between the parties. The opinion was delivered by Justice Amanda L. Reichek, with Justices Molberg and Evans participating. The judgment was entered on January 28, 2020.
