Petition for Writ of Mandamus filed by Sprint Sand and Clay, LLC, was dismissed as moot by the Fourteenth Court of Appeals on August 15, 2019. The relator sought to compel Judge Kristen Brauchle Hawkins of the 11th District Court of Harris County to vacate part of her June 11, 2019 order that partially granted and denied motions to compel from plaintiffs, John Earl Ellisor and others. On July 24, 2019, the plaintiffs submitted a letter notifying the court of their non-suit against the relator, which effectively rendered the mandamus proceeding moot. The notice of nonsuit was filed with the underlying case and is effective immediately upon filing without requiring a court order. Subsequently, on July 31, 2019, the plaintiffs formally requested the dismissal of the mandamus proceeding due to the non-suit. The court granted this motion and dismissed the relator's petition for writ of mandamus as moot. The panel included Chief Justice Frost and Justices Spain and Poissant.
