Appellate case Mattress Firm, Inc. v. Bruce Levy et al., originally filed under case number 2017-73196 in the 151st District Court of Harris County, was stayed following Mattress Firm’s Chapter 11 bankruptcy filing on October 5, 2018, which invoked an automatic stay as per 11 U.S.C. § 362(a). On December 17, 2018, Mattress Firm submitted an unopposed motion to reinstate the appeal after the bankruptcy court confirmed its Chapter 11 Plan of Reorganization on November 16, 2018, with the effective date being November 21, 2018. The Court granted the motion to reinstate the appeal and instructed the Clerk to proceed accordingly. Notably, while the clerk’s record was filed on October 9, 2018, the reporter’s record remained unpaid. The Court warned that if Mattress Firm did not provide proof of payment for the reporter’s record within 10 days of the order, it would set the briefing schedule without that record. The order was signed by Judge Evelyn V. Keyes on December 20, 2018.
