Double Diamond, Inc. and White Bluff Property Owners Association, Inc. have reached a settlement regarding their disputes in appellate cause numbers 10-17-00166-CV and 10-18-00049-CV. The parties submitted joint motions requesting the following: 1) to lift the abatement of the appeals, 2) to vacate the trial court’s final judgments in cause numbers 53310-A and 53310-B, 3) to render a judgment dismissing all claims with each party bearing their own court costs, 4) to allocate the costs of the appeals to the party incurring them, and 5) to issue the Court's mandate immediately.

The Court granted the joint motions, lifted the abatement, vacated and set aside the trial court’s judgments, and dismissed the cases with prejudice. Each party is to bear its own costs, and the appellate costs will also be borne by the incurring party. The Court's mandate will issue immediately. The opinion was delivered by Justice Al Scoggins and filed on December 19, 2018.
