Minnesota Voters Alliance v. Joe Mansky
Citation: Not availableDocket: 15-1682
Court: Court of Appeals for the Eighth Circuit; August 3, 2018; Federal Appellate Court
Original Court Document: View Document
In a case brought by Minnesota Majority and other plaintiffs against various Minnesota election officials, the Eighth Circuit Court of Appeals addressed the constitutionality of a statute prohibiting political insignia inside polling places. Initially, the plaintiffs challenged this statute under the First Amendment. The district court had previously granted summary judgment for the defendants, upholding the statute as constitutional. However, the Supreme Court reversed this decision, ruling that the statute violates the Free Speech Clause of the First Amendment. Consequently, the Eighth Circuit reversed the district court's grant of summary judgment and remanded the case for further proceedings consistent with the Supreme Court's decision.
