The Court of Appeals for the Eighth District of Texas addresses the appeal of Joe Rubio (Appellant) against the State of Texas. The reporter’s record, which was due on June 21, 2018, has not been filed due to non-payment. The Official Court Reporter, Angie Morales, indicated that full payment for the reporter’s record has not been received. Appellant’s counsel has submitted a motion for the record to be provided at county expense, but the trial court has yet to rule on it. The Court orders the trial court to conduct a hearing to ascertain whether the Appellant intends to continue the appeal. If so, the court must evaluate Appellant's financial ability to pay for the reporter’s record. The trial court is required to submit its findings to the District Clerk of El Paso County by July 23, 2018. Subsequently, the District Clerk must prepare and send a supplemental clerk’s record, including these findings, to the Court by August 2, 2018. Additionally, the court reporter is mandated to prepare, certify, and file the record of the trial proceedings with this Court by the same date. The order is issued by the Court on July 3, 2018, with participation from Chief Justice McClure and Justices Rodriguez and Palafox.
