Citation: 760 F.2d 86Docket: 82-4584
Court: Court of Appeals for the Third Circuit; April 22, 1985; Federal Appellate Court
Harcon Barge Co., Inc. is the plaintiff-appellee in a case involving multiple defendants, including D.G. Boat Rentals, Inc. and the M/V Charles D, with Southern Pacific Transportation Co. as both a plaintiff-appellant and a third-party defendant. The case is before the United States Court of Appeals for the Fifth Circuit, and it stems from prior decisions made by the United States District Court for the Western District of Louisiana. On April 23, 1985, the court addressed a petition for rehearing and suggested a rehearing en banc regarding Part III of a previous opinion issued on November 12, 1984. A majority of active judges voted to grant the rehearing en banc, which will occur without oral argument at a later date. The court denied rehearing on all other issues. Additionally, the rehearing en banc will be consolidated with another case, Steve Willie v. Continental Oil Co. et al., and a briefing schedule for supplemental briefs will be established. Judge Carolyn Dineen Randall recused herself from this decision.
