Jesus Javier Ibarra v. Citywide ATM, Inc. D.B.A Citywide ATM
Citation: Not availableDocket: 14-18-00200-CV
Court: Court of Appeals of Texas; May 22, 2018; Texas; State Appellate Court
Original Court Document: View Document
The appeal filed by Jesus Javier Ibarra against Citywide ATM, Inc. has been dismissed due to the appellant's failure to pay the required appellate filing fee. Ibarra filed his notice of appeal on December 23, 2017, but did not submit the filing fee or provide evidence of a statutory exemption. On April 26, 2018, the court directed Ibarra to pay the fee by May 7, 2018, warning that failure to do so would result in dismissal. Since the fee was not paid, the court dismissed the appeal under Texas Rule of Appellate Procedure 42.3(c), which allows for involuntary dismissal when an appellant does not comply with a clerk's notice. The decision was made by Justices Jamison, Wise, and Jewell.
