The Michigan Supreme Court has issued an order remanding the case of Ronald Lee Foster to the Wayne Circuit Court for the appointment of new appellate counsel. The Court found that Foster’s previous appellate counsel failed to file an application for leave to appeal or seek relief on his behalf, determining the appeal was "wholly frivolous" after reviewing the trial record. This negligence resulted in Foster losing his right to appeal through no fault of his own. On remand, the newly appointed counsel is permitted to file an application for leave to appeal in the Court of Appeals and/or appropriate postconviction motions within six months of their appointment. Additionally, costs of $500 are imposed on the previous attorney, Tracie Gittleman, to be paid to the Court’s Clerk. The Supreme Court does not retain jurisdiction over the case.
