An appeal was dismissed by the Court of Appeals Fifth District of Texas in the case of Frank A. Richards v. Tom's Auto Transport, Inc., stemming from a final judgment by the 192nd Judicial District Court of Dallas County on June 20, 2017. The court reporter's record was initially due on August 19, 2017. After being informed that the appellant had not requested the record, the court directed the appellant to provide verification of the request and payment status within ten days. The appellant failed to comply. Subsequently, the court ordered the appeal to be submitted without the reporter's record and required the appellant to file a brief by November 22, 2017. After further warnings and an extension until December 8, 2017, the appellant still did not file the brief. As a result, the court dismissed the appeal and ordered the appellant to pay the costs of the appeal to the appellee, Tom's Auto Transport, Inc. The judgment was entered on January 19, 2018, with participation from Justices Fillmore and Stoddart.
