On July 13, 2017, the Court of Appeals for the First District of Texas abated the appeal in the case GFH Funding, Ltd. and Gonzalez Financial Holdings, Inc. v. Kraken Holdings, LLC and Morlock, LLC to address a dispute regarding the accuracy of the reporter’s record, specifically concerning two exhibits: Defendant’s Exhibit 1 (Distribution Lists for 2012–2015) and Defendant’s Exhibit 2 (Kraken Portfolio), which were not included in the March 2, 2017 record. Following a hearing on August 14, 2017, the court reporter filed a record on September 19, 2017, indicating that the parties agreed on the inclusion of both exhibits, which were reoffered to be part of the appellate record.

The court subsequently reinstated the case on its active docket. Additionally, on June 21, 2017, the appellants filed an "Advisory to the Court and Motion for New Trial," which was dismissed as moot. The appellee is required to file their brief within 30 days from the date of the order. The order was signed by Acting Judge Russell Lloyd on October 19, 2017.
