Petitioners Raymond J. Lucia Companies, Inc. and Raymond J. Lucia have successfully obtained a grant for a rehearing en banc from the United States Court of Appeals for the District of Columbia Circuit regarding case No. 15-1345. This decision comes after consideration of the petition for rehearing, responses, and a majority vote favoring the petition. The previous judgment dated August 9, 2016, has been vacated, and oral arguments are scheduled for May 24, 2017. The court mandates that both electronic and 30 paper copies of the final briefs and the deferred appendix be filed according to a specified schedule: - Initial Brief for Petitioners: March 10, 2017 - Initial Brief(s) for Amici Curiae: March 10, 2017 - Initial Brief for Respondent: March 31, 2017 - Initial Reply Brief for Petitioners: April 10, 2017 - Deferred Appendix: April 17, 2017 - Final Briefs: April 24, 2017 The issues to be addressed in the briefs are: 1. Whether the SEC administrative law judge in this case is deemed an inferior officer under the Appointments Clause of Article II of the Constitution. 2. Whether the court should overrule the precedent set by Landry v. FDIC, 204 F.3d 1125 (D.C. Cir. 2000). Parties are instructed to deliver paper submissions to the Clerk’s office and are encouraged to minimize acronyms for clarity. Extensions to the briefing schedule will be granted only in extraordinary circumstances. Each brief must include the oral argument date on its cover. Additional orders will be issued to outline the oral argument schedule and time allocation. The clerk of the court has signed off on this order.
