On October 31, 2016, Patricia A. Maples (Appellant) filed a Plea in Abatement to suspend her appeal pending a related appeal before the United States Supreme Court. Royce L. Maples (Appellee) objected to this request on November 14, 2016. The Supreme Court subsequently granted certiorari in Howell v. Howell, addressing whether the Uniformed Services Former Spouses’ Protection Act preempts a state court’s order that requires a veteran to indemnify a former spouse for a reduction in military retirement pay due to the veteran’s post-divorce waiver of that pay for disability compensation. The Fourth Court of Appeals determined that the Supreme Court's forthcoming decision would significantly impact the appeal at hand. Consequently, the court granted the Plea in Abatement, effectively closing the case for administrative purposes until either party requests reinstatement following the Supreme Court's ruling. The order was issued on December 7, 2016.
