Robert Lee Haire, Jr. filed a motion to dismiss his appeal in the case against the State of Texas, which was pending before the Court of Appeals for the Seventh District of Texas. Both Haire and his attorney signed the motion, in accordance with Texas Rule of Appellate Procedure 42.2(a). Since no decision had been rendered by the court at that time, the motion was granted, leading to the dismissal of the appeal. The court specified that no motion for rehearing would be considered and that the mandate would be issued immediately. Justice James T. Campbell authored the memorandum opinion.
