Cecelia P. Saunders filed an “Affidavit of Illegality” in the trial court, asserting that a prior order granting a writ of possession to WRI Property Management, LLC, was void and unenforceable. After the trial court purportedly denied her affidavit, she appealed to the Supreme Court, which transferred the case to the Court of Appeals of Georgia. However, the trial court record lacked any filings following the affidavit, leading the Court of Appeals to conclude that Saunders's appeal was premature. As there was no trial court ruling to review, the Court found it could not address any issues presented. Consequently, the appeal was dismissed.
