The Supreme Court of the State of New York, Appellate Division, Fourth Judicial Department, addressed the appeal of Walgreens against the Board of Assessment Review and the Assessor of the Town of Irondequoit. The appeal stemmed from a November 16, 2010 order by Justice Kenneth R. Fisher, which granted the respondents' motion to preclude Walgreens from submitting trial-ready appraisals and expert testimony regarding the value of the property in question. Subsequent to the appeal, a Settlement Agreement was reached, approved by the Supreme Court on March 2, 2012, which resulted in the discontinuation of the proceedings. The appeal was ultimately dismissed on April 20, 2012, without costs, with all justices concurring except for Justice Green, who did not participate.
