An appeal was made to the Supreme Court of the State of New York, Appellate Division, Fourth Judicial Department, concerning an order from the Supreme Court, Erie County, which had granted Susan Kozlowski’s cross motion for a protective order against Uniland Development Company and ADF Construction Corporation. The appeal was filed by the defendant-appellant, Uniland Development Company. However, on April 20, 2016, the attorneys for both parties signed a stipulation of discontinuance, which was filed with the Erie County Clerk’s Office on April 29, 2016. Consequently, the appeal was unanimously dismissed without costs, as per the stipulation, on September 30, 2016.
