The Court of Appeals for the Fifth District of Texas has reinstated the appeals of Michael Dan Allen Johnson, Appellant, against the State of Texas, Appellee. The Court previously ordered the trial court to provide findings on the delay in filing the appellant’s brief. The findings confirm that the appellant wishes to continue with the appeals, is indigent, and has undergone a change in legal representation. Initially, Brock Duke was appointed as counsel, but he was replaced by William Schultz, whose appointment was not communicated to the Court, and Schultz did not receive necessary notices or records. Currently, Hannah Stroud has been appointed as the new counsel for the appellant and has indicated a need for approximately 45 days to prepare the brief. The Clerk is instructed to update the attorney of record to Hannah Stroud in place of Brock Duke, and the appellant is ordered to file his brief within 45 days from the date of this order.
