Hassan Chahadeh, M.D. Edward Laborde, Jr. and Donald W. Sapaugh v. Stambush Staffing, LLC
Citation: Not availableDocket: 01-16-00319-CV
Court: Court of Appeals of Texas; August 16, 2016; Texas; State Appellate Court
Original Court Document: View Document
Appellants Hassan Chahadeh, Edward Laborde, Jr., and Donald W. Sapaugh did not file their brief in a timely manner as required by Texas Rule of Appellate Procedure 38.6(a). After being notified that their appeal could be dismissed due to this failure, the appellants did not respond adequately, which is in line with the provisions of Rule 42.3(b) that permit involuntary dismissal for lack of prosecution. Consequently, Appellee Stambush Staffing, LLC filed a motion to dismiss the appeal. The court granted the motion and dismissed the appeal for want of prosecution, also rendering any other pending motions moot. The opinion was issued by a panel consisting of Justices Bland, Massengale, and Lloyd on August 16, 2016.
