Southern Pacific Transportation Company appealed a decision against Commercial Metals Company in the United States Court of Appeals for the Fifth Circuit. The appeal was remanded from the Supreme Court, which, on April 27, 1982, reversed the previous judgment of the Fifth Circuit. As a result, the court vacated its earlier ruling and instructed the district court to enter judgment in favor of Southern Pacific Transportation Company. This directive is issued in accordance with Section 9(1) of Public Law 96-452, enacted on October 14, 1980.
