The Court of Appeals for the Second District of Texas dismissed the appeal filed by Tonya Lacy and other appellants against appellee Mac Hargrove due to the appellants' failure to pay the required $175 filing fee. Notifications were sent to the appellants on December 28, 2009, and January 15, 2010, warning that the appeal would be dismissed unless the fee was paid, in accordance with Texas Rule of Appellate Procedure 42.3(c). Since the fee remained unpaid, the court dismissed the appeal, citing non-compliance with appellate procedure rules and a Texas Supreme Court order from August 28, 2007.
