In the bond forfeiture case of Jim Shaw v. The State of Texas, the Court of Appeals for the Second District of Texas addressed an appeal from a judgment signed on October 16, 2009. Although Shaw timely filed a motion for new trial, his notice of appeal, which was due on January 14, 2010, was not filed until February 3, 2010, rendering it untimely. On February 10, 2010, the court informed Shaw that his appeal could be dismissed for lack of jurisdiction unless he provided a valid response by February 22, 2010. No response was submitted by Shaw. Consequently, the court dismissed the appeal for want of jurisdiction. The memorandum opinion was delivered by a panel comprising Justices Dauphinot, Gardner, and Walker on March 18, 2010.
