The Court of Appeals for the Second District of Texas has granted the unopposed motion to dismiss the appeal filed by appellants Fountain Oaks Town Center, LLC and Jeffrey A. Rattikin against appellees Dr. Martin McGonagle and Mary E. McGonagle. The court's decision is based on Texas Rules of Appellate Procedure 42.1(a)(1) and 43.2(f). As a result, the appeals are dismissed, and the appellants are ordered to pay the costs associated with the appeals, in accordance with Texas Rules of Appellate Procedure 42.1(d).
