On April 11, 2011, the Court of Appeals for the Second District of Texas notified Khosrow Sadeghian, the appellant, that the trial court clerk had not received payment arrangements for the clerk's record necessary for the appeal, as mandated by Texas Rule of Appellate Procedure 35.3(a)(2). The court warned that failure to arrange payment within fifteen days would result in dismissal of the appeal for want of prosecution. As Sadeghian did not comply with this requirement, the court determined that the appeal should be dismissed. The dismissal was issued on June 2, 2011, with the appellant responsible for all costs associated with the appeal. The ruling was delivered per curiam by Justices Dauphinot, Gardner, and Walker.
