Debra Huett filed an affidavit of indigence for appeal costs on July 18, 2012, alongside her notice of appeal. The county clerk contested this affidavit on July 24, 2012, leading the trial court to extend the hearing period by twenty days. On July 30, 2012, the trial court sustained the contest to Huett's affidavit. According to Texas Rule of Appellate Procedure 20.1(j), Huett was required to challenge this order within ten days but failed to do so. As a result, the Court of Appeals ordered Huett to pay a filing fee of $175.00 within ten days; failure to do so would result in the dismissal of her appeal. Additionally, she must provide proof of payment or arrangements for the clerk's fee for the clerk's record within thirty days, or the appeal may be dismissed for want of prosecution. The order was signed by Justice Evelyn V. Keyes on September 7, 2012.
