Original Court Document: View Document
Christopher Ellis Fortune, the appellant, filed a motion to dismiss his appeal in the case against The State of Texas. The motion was prompted by his decision to no longer pursue the appeal. The Court of Appeals for the Seventh District of Texas, without addressing the merits of the case, granted the motion to dismiss in accordance with Texas Rule of Appellate Procedure 42.2(a). As a result, the appeal was dismissed at the appellant's request, and the court noted that no motion for rehearing would be considered. The mandate will be issued immediately, and the opinion is designated as not for publication.
