Robin Whisenhunt v. Trudy Hill
Citation: Not availableDocket: 02-12-00310-CV
Court: Court of Appeals of Texas; August 30, 2012; Texas; State Appellate Court
Original Court Document: View Document
A notice of restricted appeal was filed by Robin Whisenhunt against a default judgment from February 8, 2012, rendered in Justice of the Peace Court, Precinct 6, Tarrant County. The Court of Appeals for the Second District of Texas determined that it lacked jurisdiction to hear the appeal, as direct appeals from justice court judgments are not permissible in this court. Jurisdiction for appeals from justice courts typically lies with either the county or district courts, not directly with the court of appeals. Despite Whisenhunt’s timely filing of the restricted appeal and her argument regarding its timeliness, she failed to identify any statutory basis granting the court jurisdiction over her case. Consequently, the appeal was dismissed for want of jurisdiction. The decision was made by Justices Walker, McCoy, and Meier, and delivered on August 30, 2012.
