On January 13, 2014, the United States Supreme Court vacated the judgment of the Fourth Court of Appeals in the case of Antonio Aviles v. The State of Texas and remanded the case for further consideration in light of the Supreme Court's decision in Missouri v. McNeely. The parties are permitted to file amended briefs addressing whether the trial court erred in denying the motion to suppress evidence based on the McNeely ruling. Appellant Antonio Aviles must submit his amended brief by March 13, 2014, while the State's amended brief is due thirty days after Aviles' submission. If either party opts not to file an amended brief, they must notify the court in writing by February 21, 2014. The clerk of the court has been ordered to serve copies of this order to all involved parties.
