On January 27, 2014, RWS Transport, L.P. d/b/a Republic Waste Services and Bobby R. Mathews (Appellants) and Karla Keith (Appellee) filed an agreed motion indicating they had reached a settlement and requested the Court to abate the appeal to finalize the agreement. On February 13, 2014, the Court abated the appeal and remanded the case to the trial court, instructing that a motion to reinstate and dismiss the appeal must be submitted by April 14, 2014. If the agreement was not finalized by that date, Appellants were required to file a status report regarding the trial court proceedings and request an extension of the abatement. The parties were warned that failure to comply would lead to dismissal of the appeal without further notice. As neither party filed the required motion or status report by the deadline, the Court lifted the abatement, reinstated the appeal, and subsequently dismissed it. All pending motions were dismissed as moot. The opinion was issued by a panel consisting of Justices Jennings, Higley, and Sharp.
