Jameson Thottam v. Elizabeth Joseph
Citation: Not availableDocket: 01-13-00377-CV
Court: Court of Appeals of Texas; July 29, 2014; Texas; State Appellate Court
Original Court Document: View Document
Jameson Thottam is appealing an amended final divorce decree issued on April 29, 2013, in the case against Elizabeth Joseph. Joseph filed several motions: to compel Thottam to supplement the appellate record at his expense, to compel a corrected appellant’s brief, and for an extension of time to file her brief. The court denied Joseph's motions regarding supplementation of the appellate record and the corrected appellant's brief, and dismissed her motion for an extension of time as moot. Despite these denials, the court acknowledged that Thottam's submitted documents indicated the clerk’s record was incomplete. Thottam is ordered to file proof within 14 days that he has paid for a supplemental clerk’s record, which includes necessary items not currently in the record, or face potential dismissal of the appeal. Additionally, Thottam must file a corrected brief with appropriate references to the appellate record within 14 days of the supplemental record being filed. Joseph's brief will be due 30 days after Thottam's corrected brief is submitted. The court noted that key documents, such as the Amended Final Decree of Divorce and various motions and orders relevant to the case, were missing from the appellate record, as required by Texas appellate rules. The order was signed by Judge Jim Sharp on July 29, 2014.
