The Court of Appeals for the Second District of Texas reviewed the appeal from the 48th District Court of Tarrant County concerning Christopher and Carrie Brown versus Enterprise Recovery Systems, Inc. The court found error in part of the trial court's judgment. Specifically, the appellate court affirmed the trial court's ruling on the following claims: the Browns' Deceptive Trade Practices Act (DTPA) claim, their Texas Fair Debt Collection Practices Act claim, their claim for treble damages under the Texas Citizens Participation Act (TCPA), and their claim under 15 U.S.C. § 1692e(5) of the Fair Debt Collection Practices Act (FDCPA). However, the court reversed the trial court's judgment concerning the Browns' claims under 15 U.S.C. § 1692d(5) and § 1692d(6) of the FDCPA and ordered the case remanded for further proceedings on those claims. Each party was designated to bear their own costs of the appeal.
