Appellant Peter Barton’s brief, submitted to the Fourth Court of Appeals on July 18, 2014, was found to be in violation of several provisions of the Texas Rules of Appellate Procedure. Specifically, the brief failed to include: (1) record references in the statement of the case, (2) a brief statement of the issues presented, (3) a summary of the argument, and (4) an appendix containing the trial court’s judgment or appealable order. These deficiencies were deemed flagrant violations of Rule 38. Additionally, the brief did not adhere to the formatting requirement of double-spacing as mandated by Rule 9.4(d). The court ordered Barton to file an amended brief within fifteen days to correct these violations. If the amended brief fails to rectify the issues, the court may strike it and prohibit further submissions. Furthermore, non-compliance could lead to dismissal of the case under Rule 42.3(c). The order was signed by Justice Karen Angelini and the court clerk, Keith E. Hottle, on July 22, 2014.
