The Court of Appeals for the Thirteenth District of Texas dismissed Jerry Vesely's appeal against Anthony Eby due to a defective notice of appeal. The appellant was repeatedly notified by the Clerk’s office on April 23, 28, and 29, 2014, that the notice did not comply with Texas Rule of Appellate Procedure 25.1(d) and (e) and was requested to correct the defect. On June 10, 2014, the Court issued another notification, giving the appellant ten days to rectify the issue and warning that failure to do so would result in dismissal. The appellant did not respond or make the necessary corrections. Consequently, the Court, acting on its own motion and with a ten-day notice to the parties, dismissed the appeal for want of prosecution, citing the appellant's failure to comply with appellate rules and court notices. The dismissal was filed on July 24, 2014.
