Buford Randle, also known as Randle Buford, is appealing his conviction from the 148th District Court of Nueces County, Texas. The trial court previously certified that Randle waived his right to appeal; however, his attorney, John M. Lamerson, has indicated that Randle did not waive this right. The attorney stated that Randle asserted his right to trial, was found guilty by a jury, and was sentenced accordingly, yet no amended certification regarding the waiver has been filed.

As a result, the Court of Appeals has abated the appeal and remanded the case to the trial court for a hearing to clarify whether Randle has the right to appeal. The trial court is instructed to provide findings of fact and conclusions of law on this matter. An amended certification and any related orders must be included in a supplemental clerk's record, which the trial court is required to file with the Court of Appeals within thirty days. If the trial court needs additional time to comply, it must request an extension before the deadline expires. This order was delivered and filed on February 13, 2015.
