The United States Court of Appeals for the Third Circuit, in case No. 05-1222, involving Lynette M. Petruska against Gannon University and various defendants, has granted a petition for rehearing. The court ordered the vacating of its previous judgment dated May 24, 2006, and will refer the case to the original panel for further consideration. This decision was necessitated by the death of Judge Edward R. Becker and the recusal of Judge Richard L. Nygaard. Judges Morton I. Greenberg and Robert E. Cowen, selected by random lottery, will join Judge D. Brooks Smith in the panel assigned to rehear the case. The order was issued by Chief Judge Anthony J. Scirica on June 20, 2006.
