Relators SXP Analytics, LLC and Emmanuel M. Mamalakis filed a petition for writ of mandamus on December 2, 2011, seeking to compel Judge Jaclanel McFarland of the 133rd District Court, Harris County, to set aside her October 24, 2011 order which denied their motion to decline jurisdiction based on forum non conveniens in the case of Vitaliy Godlevsky v. SXP Analytics, LLC, Jepp Financial LLC, and Emmanuel M. Mamalakis. On December 13, 2011, relators sought a temporary stay of discovery and all proceedings in the trial court, which was denied by this court. Following this, relators filed a supplemental motion indicating that Godlevsky requested an anti-suit injunction against them regarding a related suit in Wisconsin, with a hearing scheduled for December 19, 2011. The court determined that the relators’ situation warranted further consideration and immediate temporary relief. Consequently, the court granted the supplemental motion in part, staying all proceedings related to the anti-suit injunction until a final decision on the writ of mandamus or further order. Additionally, Godlevsky is required to respond to the petition by December 28, 2011. The decision was made by a panel consisting of Chief Justice Hedges and Justices Boyce and Christopher.
