Jordan Nathaniel Garza, the appellant, sought to appeal a judgment from the 156th District Court of Bee County, Texas, where his sentence was imposed on October 17, 2002. The notice of appeal was due by November 18, 2002, but was not filed until November 21, 2002, rendering it untimely. Additionally, Garza submitted an untimely motion to extend the time for filing the notice of appeal on January 13, 2003. Under Texas Rule of Appellate Procedure 26.3, a court may grant an extension if a notice is filed within fifteen days after the deadline and accompanied by a motion explaining the need for the extension. Garza failed to meet these requirements. Consequently, the court determined that it lacked jurisdiction due to the untimely filing and dismissed the appeal. Garza's motion for late filing of the notice of appeal was also dismissed. The opinion was delivered on April 17, 2003, and the ruling is not to be published.
