Appellants Valinda S. Parrish, Danny D. Stilley, William H. Stilley, Harold Stilley, and Carrol R. Callaway filed a motion to dismiss their claims against Appellees, which include Peggy Yarborough, the independent executor of the estate of Vonnia Ophelia Anz, and others, in the Court of Appeals for the Twelfth District of Texas. On January 11, 2006, the court granted the Appellants' motion to dismiss. Subsequently, Appellees filed a motion to dismiss their cross-appeal, which was granted as they satisfied the requirements of Texas Rule of Appellate Procedure 42.1(a)(1). Consequently, the appeal was dismissed. The opinion was delivered on January 25, 2006, by a panel consisting of Chief Justice Worthen and Justices Griffith and DeVasto.
