Vecentie Morales, Jr. filed an appeal against Fingerhut Corporation but did not pay the required $125 filing fee or submit an affidavit of inability to pay, as mandated by TEX.R.APP.P. 20.1. On November 3, 2004, the 11th Court of Appeals in Eastland, Texas, directed Morales to pay the fee, warning that failure to do so could lead to dismissal of the appeal under TEX.R.APP.P. 42.3(c). As of the date of the memorandum opinion, Morales had not complied with this directive, resulting in the dismissal of the appeal.
