Carl Giles appealed a decision involving the Texas Department of Mental Health and Mental Retardation from the 74th District Court of McLennan County. The appeal was initiated with a notice filed on December 8, 2000, and the clerk’s record was submitted on February 13, 2001. However, Giles failed to pay for the preparation of the reporter’s record and did not respond to notifications regarding this issue. He did not file a brief or request an extension by the deadline, and after informing him that the appeal would be dismissed for want of prosecution due to his inactivity, no response was received. Consequently, the court dismissed the appeal on August 15, 2001, for lack of prosecution, with costs assessed against Giles. This decision was rendered per curiam by the panel of justices.
