Appellant Marcus Allen Monson was convicted on January 9, 2008, for unlawful possession of a firearm by a felon and sentenced to three years in prison. He filed a timely notice of appeal but later expressed his desire not to continue with the appeal. On May 21, 2008, the Court of Appeals ordered a hearing to ascertain his intentions regarding the appeal and whether he required appointed counsel. During the hearing on June 6, 2008, Monson confirmed he no longer wished to pursue the appeal after discussing it with his attorney. The trial court provided findings of fact on June 23, 2008, supporting Monson’s decision to dismiss the appeal. Although no formal written motion was filed as typically required, the Court found good cause to suspend Rule 42.2(a) and dismissed the appeal based on Monson's testimony and the trial court's findings. The dismissal was issued on September 11, 2008, by Chief Justice David Wellington Chew and Justices McClure and Carr.
