The Court of Appeals for the Seventh District of Texas addressed the appeal of Trena and Timothy regarding the termination of their parental rights by the trial court. The Court affirmed the termination of the parental rights of any alleged or unknown father concerning the child J.O.A., and also affirmed the appointment of the maternal grandmother as managing conservator for both J.O.A. and T.J.A.M. However, the Court reversed the termination of Timothy's parental rights to the twins, T.J.M. and C.T.M., and remanded that aspect for further proceedings. Following the appeal, attorney Luke Inman filed a Motion to Withdraw, citing his new position as the 100th Judicial District Attorney and a conflict of interest due to his representation of both Trena and Timothy, with Timothy prevailing on appeal. The Court noted that the trial court has the authority to appoint counsel for indigent parents in such cases under Texas Family Code § 107.013. The Court abated the Motion to Withdraw and remanded the case to the trial court to determine whether to grant Inman's motion. If granted, Inman is required to notify the parties of any pending deadlines or settings. The trial court is also instructed to take any additional actions deemed necessary and to file a supplemental clerk's record with the orders by May 26, 2008.
