Rolando Flores v. State
Citation: Not availableDocket: 07-04-00065-CR
Court: Court of Appeals of Texas; April 30, 2004; Texas; State Appellate Court
Rolando G. Flores appeals his conviction for assault family violence from the 137th District Court of Lubbock County. The court imposed sentence on January 8, 2004, and Flores filed a general notice of appeal on February 11, 2004. However, the appellate court clerk raised concerns regarding jurisdiction due to the timing of the notice, which must be filed within 30 days of sentencing or following an appealable order, unless a motion for new trial is filed. Flores did not file a motion for new trial or a timely notice of appeal, nor did he respond to the court's request for clarification on jurisdiction. As a result, the court concluded that it lacked jurisdiction to hear the appeal due to the untimely filing. The appeal was dismissed for want of jurisdiction, in accordance with Texas Rules of Appellate Procedure.
