David Solomon Maze has appealed his conviction, represented by counsel who submitted an Anders brief. Maze has expressed a desire to file a pro se response but has been unable to access the clerk’s records necessary for this purpose despite multiple requests. Consequently, the appeal has been abated pending his access to the records. The Court has remanded the case to the Criminal District Court of Jefferson County, instructing the trial court to conduct a hearing to establish whether Maze has had sufficient access to the clerk’s record. If it is determined that he has not had reasonable access, the trial court must take necessary actions to ensure he can prepare a response to the Anders brief. The trial court is required to conduct hearings, file findings of fact and conclusions of law, enter appropriate orders, ensure the hearings are transcribed, and compile a record of the proceedings. All records related to this remand must be submitted to the Court of Appeals by May 16, 2003.
