Anthony Trent Barbour appeals his conviction for injury to a child, for which he received a twenty-year prison sentence on November 8, 2007. Although he filed a timely motion for a new trial, his notice of appeal was submitted on February 22, 2008, past the deadline established by Texas Rule of Appellate Procedure 26.2(a)(2), which required that the notice be filed by February 6, 2008. Consequently, the notice of appeal is deemed untimely, and the Court of Appeals lacks jurisdiction to hear the case. The appeal is dismissed for want of jurisdiction. Justice Moseley authored the memorandum opinion, and the case was submitted on May 6, 2008, with a decision rendered on May 7, 2008.
