Justice Paul W. Green dissents regarding the denial of a rehearing in the case of Gutierrez v. Deloitte, asserting that the panel incorrectly held that DT-Cayman is subject to Texas jurisdiction. Initially, Justice Green had concurred with the panel's decision but has since revised his stance, believing that DT-Cayman lacked purposeful contacts with Texas necessary for jurisdiction. DT-Cayman, a Caymanian entity, was engaged by another Caymanian firm, InverWorld, to provide accounting services, which required collaboration with DT-Texas for field work in Texas due to InverWorld's San Antonio office. However, the mere performance of services by DT-Texas does not establish sufficient grounds for jurisdiction over DT-Cayman, as supported by relevant case law. The trial court’s implied finding that DT-Cayman's Texas contacts were inadequate to meet the minimum contacts requirement is upheld. Justice Green would affirm the trial court's order. Retired Chief Justice Phil Hardberger did not participate in the decision.
